This agreement is made and entered into this ______ day of __________________ 20__ by and between Wasatch Newfoundlands L.L.C. (Seller),
and____________________________________ (Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Newfoundland from the litter whelped on ____________________________________ out of _______________________________ and________________________________.
For $__________, the seller agrees to sell and the buyer agrees to purchase a female_____, male ____ companion puppy from the litter described above subject to the following terms.
1. Seller warrants that the above described puppy/dog is a purebred Newfoundland
registerable with the American Kennel Club with Limited Registration, and that "Limited" registration papers, (together with a true copy of its pedigree--if requested), will be provided to Buyer upon full payment of puppy.
2. Seller warrants that the above-described puppy/dog is in good health at the time Buyer assumes ownership and has received a Clean Bill of Health by a licensed Veterinarian--which included a heart check, (and if male, a testicle check and Vet has determined that this puppy is not a Cryptorchid.) Seller also warrants that the puppy has been dewormed and has received first shots. Buyer assumes the responsibility to keep pup de-wormed throughout the remainder of it's life and also to keep pup up to date on shots and rabies during the remainder of this contract.
3. IF PUPPY DOES NOT APPEAR HEALTHY UPON ARRIVAL TO NEW HOME, Buyer agrees to have the puppy examined by a licensed Veterinarian within two(2) days (not including weekends and holidays) of receipt of puppy/dog--at Buyers Expense--BUT IF PUPPY IS IN GOOD HEALTH AS STATED ABOVE in #2, VETERINARIAN EXAM IS NOT MANDATORY.
If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund. If the buyer elects to return the puppy, Buyer shall, within 14 days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian’s certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Sellers at Buyers expense. Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void. All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind include temperature at time of shipment, non-stop flights, etc.
4. The Seller has determined that the puppy/dog is of “pet quality” and is NOT to be bred. In such case, Seller shall provide Buyer with AKC Limited Registration Certificate upon proof of Spay/Neuter, which must be done by the age of 10 months old. Seller also does NOT guarantee that this puppy, will not be or carry Cryptorchidism. But the seller does guarantee that the sire of these puppies is NOT a Cryptorchid.
NOTE: Buying a puppy sold as a "pet" means you will spay or neuter the dog and that it will be limited registered with AKC. Proof of Neuter/spay will be required by the breeder. All Guarantees are VOID if puppy has not been Neutered/Spayed (at Buyers Expense) by the age of 10 months old.
5. If said puppy/dog develops hip or elbow dysplasia within 18 months from date of birth, the Buyer may return the dog to Seller and will receive a replacement puppy/dog of like quality from the next available litter, or may keep the dog, which has been spayed or neutered, and Seller will refund $500. Puppy must be examined by a Veterinarian--at Buyer's expense, to determine that puppy has elbow or hip dysplasia. A Copy of the Veterinarian's Certificate, stating that the puppy has elbow or hip dysplasia must be sent to the Seller at the Buyer's expense within 3 days of Veterinarian Examination. All pups will be spayed or neutered by the age of 10 months for this guarantee to cover the remaining months.
If Buyer chooses a replacement puppy/dog, Buyer and Seller shall make prompt arrangements within 10 days of receipt of certified letter and Veterinarian certification for return of the puppy/dog sold herein to Sellers place of business. Buyer shall be responsible for taking good and reasonable care of the puppy/dog until Seller receives it. Costs and related expenses of returning the puppy/dog to Seller shall be the obligation of the Buyer. Seller will not be responsible for any vet expenses concerning said puppy/dog.
6. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $________ to be paid as follows: $______deposit on execution of the Agreement with the balance of $_________ to be paid on or before the puppy/dog leaves the Sellers premises. If the balance is not paid by ________________________, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.
7. If delivery is requested by Buyer, it shall be by ground shipping to a designated location, unless other arrangements are made with Seller. Buyer is responsible for costs of crate, insurance during shipment, and cost of freight charges. If Seller has to purchase crate prior to shipping, Buyer shall reimburse Seller in full for this cost.
8. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy/dog and that Buyer will not sell this puppy/dog or its progeny to any agent, pet store or guard dog business.
9. Buyer agrees that this puppy/dog will not be bred at any time or age. Buyer also agrees that if said puppy/dog is bred rather than neutered or spayed, that the resulting litter and/or moneys from the resulting litter will be the property of Wasatch Newfoundlands. Buyer also agrees to pay or re-emburse all legal expenses--Attorney Fees and Court Fees, on behalf of Wasatch Newfoundlands if said puppy/dog is bred and Wasatch Newfoundlands brings a lawsuit against Buyer in Court to Re-possess resulting litter of puppies and the dam/sire of the puppies, or moneys made from resulting litter of puppies, up to $10,000.
10. Buyer agrees that the puppy will reside at the home of the Buyer, have access to a fenced yard, not be chained or tethered, and will be provided with proper housing, a good quality diet, annual shots and exercise. Buyer agrees that at least one basic obedience training course will be completed with the puppy/dog.
11. Any dog or puppy that is returned for a refund and shows signs of physical or mental abuse will immediately void the terms of this contract and the new owner will not be entitled to a $ refund or exchange of puppy/dog for any reason. But the Seller retains the right to repossess the dog.
This Agreement is made and signed by both parties to insure the well being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations (by seller) under this Agreement. Clause number 9 will remain in place.
This contract is legally binding. Any violation of this contract will result in immediate repossession of the dog with no refund or replacement.
